Welcome to Elm Tree Health. These Terms & Conditions (“Terms”) govern your access to and use of the website, telehealth platform, and related services (collectively, the “Services”) provided by Elm Tree Health (“Elm Tree,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing our website or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
2. Description of Services
Elm Tree Health provides Medicare Annual Wellness Visits (AWV) via telehealth. Our licensed healthcare providers conduct personalized preventive health assessments, create individualized wellness plans, and help you make the most of your Medicare preventive benefits. The AWV is a covered benefit under Original Medicare (Part B) at no cost to you when you have had Medicare Part B for longer than 12 months.
3. Eligibility
To use our Services, you must:
- Be aged 65 or older.
- Be enrolled in Original Medicare (Part B) for more than 12 months.
- Not have received an Annual Wellness Visit within the past 12 months.
- Reside in a state where Elm Tree Health is authorized to provide telehealth services.
- Have access to a telephone or internet-connected device capable of supporting a telehealth visit.
We reserve the right to verify your eligibility and decline service if eligibility requirements are not met.
4. Not a Replacement for Your Primary Care Provider
Our Services are designed to supplement—not replace—your relationship with your primary care provider (PCP). The Annual Wellness Visit is a preventive health assessment and does not include diagnosis or treatment of acute or chronic conditions. We strongly encourage you to maintain regular care with your PCP and to seek immediate medical attention for any urgent health concerns. If you are experiencing a medical emergency, call 911 immediately.
5. Telehealth Consent
By scheduling and participating in a telehealth visit, you acknowledge that you have read and agree to our Telehealth Consent and understand the nature, risks, and benefits of receiving healthcare services via telehealth. You consent to receiving care through audio and/or video communication technologies and understand that telehealth is not a substitute for in-person care when clinically necessary.
6. $75 Wellness Reward
Eligible participants who complete their Annual Wellness Visit may receive a $75 wellness reward. The following terms apply:
- The reward is paid by Elm Tree Health from Medicare reimbursement funds and is not charged to Medicare, your insurance, or you.
- The reward is issued after the visit is completed and the associated Medicare claim has been processed.
- Delivery method (prepaid card, digital gift card, or check) and timing may vary. Typical delivery is within 4–6 weeks after visit completion.
- Limit one reward per eligible individual per calendar year.
- The reward may be considered taxable income. You are responsible for any applicable tax obligations.
- Elm Tree Health reserves the right to modify, suspend, or discontinue the reward program at any time.
7. Intellectual Property
All content on our website—including text, graphics, logos, images, and software—is the property of Elm Tree Health or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Elm Tree Health, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, including but not limited to damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from or relating to the Services shall not exceed the amount you paid, if any, for the Services during the twelve (12) months preceding the claim.
9. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions. Any legal proceedings arising under these Terms shall be brought exclusively in the state or federal courts located in Arlington County, Virginia.
11. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiation. If the parties are unable to resolve the dispute within thirty (30) days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Arlington, Virginia. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will post the revised Terms on this page and update the “Last updated” date above. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
